Terms of Service

1. Acceptance of Terms

By accessing and using the EventGo platform, you agree to these Terms of Service, which create a legally binding contract between you and EventGo Digital Inc. ("EventGo"). If you do not accept these Terms, you may not use our services. For business users acting on behalf of an entity, you confirm that you have the authority to accept these Terms on behalf of your organization.

2. EventGo’s Services and Platform Functionality

EventGo provides a digital platform where users can create, manage, promote, and participate in events. Organizers use our platform to list events, sell tickets, and manage event logistics, while attendees can browse, register for, and purchase event tickets. We provide tools and infrastructure to facilitate these activities but are not responsible for the planning or execution of events. EventGo does not directly control or manage any events listed on the platform.

3. Privacy and User Data

EventGo is committed to protecting the privacy of all users. By using our services, you agree to our collection, use, and sharing of your personal information as outlined in our [Privacy Policy], which forms part of these Terms. 4. Duration and Termination

4.1 Term
These Terms remain in effect as long as you use EventGo’s platform. You may terminate your agreement with us by deleting your account or ceasing to use our services.

4.2 Termination by EventGo
We reserve the right to suspend or terminate your account at any time if you violate these Terms, fail to pay any applicable fees, or engage in misuse of the platform. In such cases, we may terminate your access immediately and, where possible, provide notice of the action.

4.3 Consequences of Termination
Upon termination, you will lose access to your account and any content or data associated with it. Certain sections of these Terms, including those relating to liability, indemnification, and dispute resolution, will survive termination.

5. Export Restrictions

EventGo’s services are subject to Canadian export control laws and regulations. Users must comply with all applicable international trade laws when using our platform. This includes restrictions on using the platform in specific countries or by persons or entities that are subject to trade sanctions.

6. Responsibility and Indemnity

6.1 Responsibility for Your Actions
You are responsible for your activities on the platform, including all content you post and any interactions you have with other users. If you are an Organizer, you must ensure that your events comply with all applicable local, provincial, and federal laws.

6.2 Indemnity
You agree to indemnify and hold harmless EventGo and its affiliates from any claims, damages, liabilities, or expenses arising out of your use of the platform, breach of these Terms, or any violation of applicable laws.

7. Disclaimer of Warranties and User Assumption of Risk

EventGo provides its services "as is" without warranties or guarantees of any kind, whether express or implied. While we strive to ensure the platform operates smoothly, we do not guarantee that it will always be error-free, uninterrupted, or meet your specific expectations.

By using the platform and attending events, you assume all risks associated with these activities. This includes the risk of injury, illness, or other harm arising from event attendance or participation.

8. Limitation of Liability

To the extent permitted by Canadian law, EventGo’s liability for any damages arising out of your use of the platform is limited to the amount you paid for our services in the three months preceding the event giving rise to the claim. EventGo is not liable for indirect, incidental, or consequential damages, including loss of profits or data.

9. Dispute Resolution: Arbitration and Waiver of Class Actions

Any disputes arising out of or in connection with these Terms must be resolved through binding arbitration, in accordance with the laws of Ontario, Canada. Arbitration will take place in Toronto, unless otherwise agreed by both parties. By agreeing to these Terms, you waive the right to participate in class action lawsuits or consolidated legal actions.

10. Access Rights to EventGo Services

EventGo grants you a limited, non-transferable, revocable license to access and use the platform solely for the purpose of organizing or attending events. Any other use of the platform without prior written consent is prohibited.

11. Organizers' Obligations for Licenses and Permits

If you are an Organizer, you are responsible for obtaining all necessary licenses, permits, and approvals for your events. This includes, but is not limited to, local business permits, health and safety regulations, and venue authorizations. EventGo will not be liable for any legal or regulatory non-compliance.

12. Copyright Infringement Notification

If you believe that any content on the platform violates your copyrights, you may submit a notification in accordance with applicable Canadian copyright laws. Please ensure that your complaint includes the necessary details to verify the claim.

13. Prohibited Activities and Misuse of Content

Users are prohibited from engaging in activities that harm the platform, including unauthorized scraping, copying, or other misuse of EventGo’s content or services. Any attempt to disrupt the platform, exploit its vulnerabilities, or use the content for unauthorized commercial purposes is strictly forbidden.

14. Service Fees and Refund Policy

14.1 Service Fees
EventGo offers a range of services that facilitate ticket sales, event listings, booth sales, and sponsorship arrangements. For services that involve financial transactions, EventGo charges a service fee. The breakdown of these fees is as follows:

All fees will be clearly disclosed during the event creation process, and organizers will have the opportunity to determine how the fees are allocated. These fees may vary depending on the type of event and the specific services utilized.

14.2 Refunds
When creating an event, organizers will have the option to determine how refund-related service fees are handled. Specifically, the organizer can choose whether the service fees related to refunds will be:

This choice will be set during the event setup process and must be clearly communicated to event attendees during the purchase process. EventGo is not responsible for disputes arising from refund policies and will follow the organizer's refund instructions as provided.

15. Account Creation and Management

To access certain features of the platform, you must create an account and provide accurate and up-to-date information. You are responsible for maintaining the security of your account and for any activities that occur under your login credentials.

16. Content Ownership and License to Use

By uploading or posting content on EventGo, including event descriptions and trademarks, you grant us a non-exclusive, royalty-free license to use, display, and distribute this content for the purpose of delivering our services and promoting your events. You retain ownership of your content, but EventGo has the right to use it as necessary to operate the platform.

17. Communication and Legal Notices

18. Amendments to Terms and Services

EventGo reserves the right to update these Terms at any time. If we make significant changes, we will notify you through the platform or via email. Continued use of the platform after such updates constitutes acceptance of the revised Terms.

19. Transfer of Rights

EventGo may assign its rights and obligations under these Terms to a third party in the event of a corporate transaction, merger, or sale of assets. You may not transfer your rights or obligations under these Terms without EventGo’s prior written consent.

20. Full Agreement

EventGo may provide links to third-party websites or services for user convenience. We do not endorse or take responsibility for the content or services provided by third parties, and you use such links at your own risk.

24. Miscellaneous Provisions

If EventGo fails to enforce any part of these Terms, it does not waive our right to enforce such provisions in the future. Should any part of these Terms be found unenforceable, the remaining provisions will continue in full force and effect. Section headings are for convenience only and have no legal effect.
